This End User License Agreement (the "EULA") governs your installation and use of the MonkeyThorn Meet iOS application (the "Licensed Application") published by James Tannahill (the "Licensor"). The Licensed Application is distributed through the Apple App Store and is subject to both this EULA and Apple's Media Services Terms and Conditions.
You acknowledge that this EULA is concluded between you and the Licensor only, and not with Apple. The Licensor, not Apple, is solely responsible for the Licensed Application and the content thereof.
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.
Support requests may be sent to support@monkeythorn.com. The Licensor will use commercially reasonable efforts to respond but provides no service-level commitment.
The Licensed Application is provided on an "as-is" and "as-available" basis, without warranties of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Licensor's sole responsibility.
You acknowledge that the Licensor, not Apple, is responsible for addressing any of your or any third party's claims relating to the Licensed Application or your possession and use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit, HomeKit, or comparable frameworks (none of which are used by the Licensed Application).
You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
The Licensed Application may include or interoperate with third-party materials, including the LiveKit client SDK (Apache License 2.0) and the underlying WebRTC implementation. Use of such materials is subject to their respective licenses, copies of which are available from the corresponding upstream projects.
You and the Licensor acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
This EULA is effective until terminated by you or the Licensor. Your rights under this EULA will terminate automatically without notice from the Licensor if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Licensed Application and destroy all copies of the Licensed Application from your devices.
The Licensor may modify this EULA from time to time. The current version is always posted at this URL, with the effective date above. Continued use of the Licensed Application after a change constitutes acceptance.
Except to the extent expressly provided in the following paragraph, this EULA and the relationship between you and the Licensor are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in New York County, New York. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
